Terms of use

1. Purpose
These terms of use govern access to and use of the Hyvirtus service, published by Murat ERTURK, a sole trader (see legal notice).
Hyvirtus is a tool for the psychology of trading practice. The service observes, reads, structures and reveals behavioral elements from the data entered by the user. Hyvirtus is neither an investment advice service, nor a trading signals service, nor a financial market prediction service. See the "No financial advice" section for a specific clause.
2. Acceptance of these terms
Creating an account and using the service constitute full and unreserved acceptance of these terms of use. If the user does not accept all or part of these terms, the user must refrain from using the service.
3. Access conditions
Access to Hyvirtus is reserved for natural persons who are:
- At least eighteen years old on the date of account creation.
- Of full legal capacity to enter into a contract.
- Accepting that their personal data be processed in accordance with the privacy policy.
Use by a minor is strictly prohibited. The publisher reserves the right to suspend any account it discovers to have been created in breach of this rule.
4. Account creation
Creating an account requires providing a valid email address. The user undertakes to provide accurate information and to keep it up to date. Only one account per natural person is allowed.
The user is solely responsible for the confidentiality of their access credentials and for any use made of them. The user must notify the publisher without delay of any unauthorized use of their account.
5. Description of the service
The Hyvirtus service brings together the following surfaces:
- The Ritual: a grounding space before the trading session (inner state, intention, pillar of the day).
- Dojo Live: psychological reading during the session and during a trade.
- The Timeline: behavioral memory read over time, structured around the six pillars.
- The Journal: a free writing space connected to the pillars.
- The Analyses: reviewing trading events (free introspection or CSV import).
- The training Dojo: off-market scenarios and pillar verdict.
- The Dashboard: an overview of the artifacts produced (audits, readings, sessions).
- The Trader profile: declared identity and operating framework.
- The Notification center: surfacing of available artifacts (Weekly Audit, Monthly Report, Hyvirtus readings).
The details of the features are presented on the Hyvirtus site and may change over time.
6. No financial advice
Hyvirtus is not an investment services provider (PSI), is not a financial investment advisor (CIF), is not a digital asset services provider (PSAN). Hyvirtus is not registered with any financial supervisory authority.
The service provides no trading signals, no investment recommendations, no financial market predictions. Hyvirtus observes, reads, structures and reveals behavioral elements. It never prescribes.
The user remains solely responsible for their trading decisions and their financial consequences, including any losses. Trading in financial instruments carries a risk of capital loss. The user acknowledges being aware of these risks and declares that they make their decisions in an informed and autonomous manner.
7. User obligations
The user undertakes to:
- Use the service on a strictly personal and non-commercial basis.
- Not resell, sublease, or make available to third parties their account or the content produced by Hyvirtus.
- Not automatically extract, scrape, or attempt to copy in bulk the content of the site or the application.
- Not seek to circumvent, disassemble, decompile or reverse-engineer the technical components of the service, in particular the backend mechanisms tied to Hyvirtus.
- Provide accurate data at the time of the Ritual, the Journal and the Trader profile, it being understood that the relevance of Hyvirtus readings depends on this accuracy.
- Not use the service for unlawful or fraudulent purposes, or purposes contrary to public order.
- Comply with the reasonable daily usage limit per account described below.
To prevent abusive, automated or fraudulent use (bots, scripts, bulk generation), access to the readings generated by Hyvirtus is subject to a reasonable daily usage limit per account. This limit is expressed as a volume of compute (tokens) and corresponds, for information, to several hundred thousand tokens per account per day, a level far beyond normal individual use, even intensive use. Beyond this limit, the readings generated by Hyvirtus are temporarily suspended and resume automatically the next day (Paris time). The publisher may offer a plan that raises this daily ceiling.
8. Hyvirtus intellectual property
The publisher remains the sole owner of all the elements making up the service: frontend and backend source code, product doctrine, Hyvirtus prompts and logic, graphic identity, sigil, palette, typefaces and their arrangement, editorial content, trademarks and distinctive signs.
Use of the service grants the user a personal, non-exclusive, non-transferable right, limited in time, to access and use the service on a personal basis. No other right is granted.
9. Data entered by the user
The user remains the sole owner of the content they enter into the service, in particular Journal entries, Ritual elements, and Analyses annotations.
By using the service, the user grants Hyvirtus a non-exclusive, worldwide and free license, limited to the duration of actual use of the service, to:
- Store, process and return this content to the user themselves.
- Transmit it to Hyvirtus for the sole purpose of producing the behavioral readings of the service.
- Produce aggregated and anonymized statistics on the overall use of the service, under the conditions set out in the privacy policy.
This license ends upon deletion of the account, subject to the legal retention periods and the anonymization operations described in the privacy policy.
10. Availability of the service
The publisher undertakes to provide the service with reasonable care, as a best-efforts obligation. Availability is not guaranteed to be 100 percent: interruptions may occur for scheduled maintenance, updates, or due to unforeseen technical failures.
The publisher implements reasonable continuity measures and will inform users of major maintenance operations likely to durably affect access.
11. Suspension and termination by the publisher
The publisher reserves the right to suspend or terminate a user's access, without notice or compensation, in the event of:
- Serious or repeated breach of these terms of use.
- Fraud or attempted fraud.
- Abusive or insulting behavior, or behavior that undermines the security of the service.
- Use by a minor in breach of the "Access conditions" section.
In the event of termination for one of these reasons, the user will not be entitled to any refund.
12. Termination by the user
The user may terminate their account at any time, from the service interface or by a simple request sent to contact@hyvirtus.com. Termination takes effect without delay for free accounts, and at the end of the current paid period for paid accounts.
The actual deletion of data is governed by the privacy policy.
13. Limitation of liability
The publisher's liability is limited to proven direct damages resulting from established fault in the performance of the service.
Expressly excluded from the scope of the publisher's liability are:
- Financial losses incurred by the user in the course of their trading operations, these operations being exclusively a matter of the user's own decision and own responsibility.
- Indirect damages, including loss of business, loss of opportunity, damage to reputation.
- The consequences of any use of the service that does not comply with these terms of use.
No clause of these terms of use may, however, exclude or limit the publisher's liability in the event of gross negligence, willful misconduct, or infringement of rights whose limitation is prohibited by the mandatory provisions of French law.
14. Changes to the terms of use
The publisher may amend these terms of use to reflect changes in the service or in regulations. Any substantial change will be notified by email to users with an active account, at least thirty days before it takes effect. A user who refuses the new terms may terminate their account during this notice period.
15. Governing law and jurisdiction
These terms of use are governed by French law.
In the event of a dispute, and in accordance with Article R631-3 of the French Consumer Code, the consumer may bring the matter, at their choice, before the court of the place where they resided at the time the contract was concluded or where the harmful event occurred, or before the court of the defendant's place of residence.
16. Consumer mediation
In accordance with Articles L611-1 et seq. of the French Consumer Code, the publisher is registered with a consumer mediation service. After sending a written complaint to the Hyvirtus support team at contact@hyvirtus.com and failing a satisfactory reply within one month, the consumer may use the following mediator free of charge:
