Terms of sale

1. Purpose

These terms of sale govern how subscriptions to the Hyvirtus service are taken out, paid for and cancelled, in addition to the terms of use. They apply to any order placed by a consumer within the meaning of the French Consumer Code.

2. Seller identification

The seller is Murat ERTURK, sole trader. The full identity and contact details are set out in the legal notice.

3. Description of the offer

Hyvirtus provides access to its service by subscription, preceded by a free trial period, under the following plans:

  • Monthly subscription: 29.99 euros incl. tax per month.
  • Annual subscription: 287.90 euros incl. tax per year.

Free trial period. Every first subscription begins with a free trial period of seven (7) days. A valid payment method must be registered when subscribing. No amount is charged during the trial. At the end of the seven days, unless cancellation occurs before that date, the subscription continues automatically under the chosen plan and the first charge takes place at the end of the trial, then at each due date according to the chosen periodicity.

Each plan gives access to all the service surfaces described in the terms of use. The exact content of each plan, the amount, and the length of the trial period are displayed on the subscription page at the time of the order.

Daily usage limit. Access to the readings generated by Hyvirtus is subject to a reasonable daily usage limit per account, intended to prevent abusive, automated or fraudulent use. This limit, expressed as a volume of compute (tokens) and set at a level far beyond normal individual use even intensive use, is described in the terms of use. The publisher may offer a plan that raises this daily ceiling.

4. Order

Orders are placed online from the Hyvirtus website. They involve the following steps:

  1. Choice of the subscription plan.
  2. Account creation or sign-in by means of a connection link sent by email.
  3. Entry of payment information through the secure Stripe form, registration of a payment method being required to open the free trial period.
  4. Express acceptance of these terms of sale.
  5. Order confirmation by email.

The order becomes firm and final from the moment the confirmation is sent by email.

5. Price and payment

Prices are stated in euros, all taxes included. They may change over time, it being understood that the rate applicable to an ongoing subscription is the one in force on the day of subscription, except where a change is notified under the conditions set out in the "Automatic renewal" section.

Payment is entrusted to the provider Stripe Payments, PCI-DSS certified. No complete banking data is ever stored by the publisher. The accepted payment methods are those supported by Stripe on the day of the transaction (bank cards from the main networks, and, subject to availability, SEPA direct debits and digital wallets).

Every first subscription begins with a free trial period of seven days, with no charge. At the end of this period, unless cancellation occurs before its term, the subscription gives rise to an automatic recurring charge according to the chosen periodicity, the first charge taking place at the end of the trial. An invoice is issued at each due date and made available in the user area.

6. Value Added Tax (VAT)

The applicable value added tax is that of the consumer's country of residence, in accordance with the VAT regime for electronic services within the European Union (the "One Stop Shop" OSS scheme). VAT is calculated and collected via Stripe Tax. The applicable rate is displayed separately at the time of subscription.

7. Right of withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, you have a period of fourteen (14) days to exercise your right of withdrawal, without having to give any reason for your decision or bear any costs other than those provided for by law. This period runs from the conclusion of the contract, that is to say from your subscription, independently of the free trial period of seven (7) days and of the deferral of the first payment.

You are informed, clearly and explicitly at the time of subscription, that at the end of the free trial period of seven (7) days the subscription automatically becomes payable at the rate of the chosen plan, unless you cancel before that term.

Hyvirtus does not ask you to waive your right of withdrawal. You retain this right in full during the fourteen (14) days, including if you have started to use the service and including after the first charge taking place at the end of the trial.

In the event of withdrawal, any amount already charged is refunded to you in full, and no amount is due in respect of the free trial period. The refund is made under the conditions and within the time limits provided for in Articles L221-23 et seq. of the French Consumer Code.

An acknowledgement of your withdrawal is sent to you without delay on a durable medium (email).

How to exercise your right of withdrawal

You can exercise your right of withdrawal, before the expiry of the fourteen (14) day period:

  • by means of the online withdrawal function accessible from your personal area, in accordance with Article L221-21 of the French Consumer Code;
  • by email sent to contact@hyvirtus.com;
  • or by means of the model form reproduced below.

8. Automatic renewal

Hyvirtus subscriptions renew automatically at the end of each period, under the chosen plan, unless cancelled beforehand.

In accordance with Article L215-1 of the French Consumer Code, the publisher will inform the user, in writing or electronically, at the earliest three months and at the latest one month before the end of the automatic renewal period, of the possibility of not renewing the contract. On this occasion the user has a free right of cancellation.

For renewed annual subscriptions, in accordance with Article L215-2 of the French Consumer Code, the user may cancel at any time and without charge from the renewal date.

9. Cancellation

The user may cancel their subscription at any time from their personal area, via the secure subscription management portal provided by Stripe, or by written request sent to contact@hyvirtus.com.

Cancellation takes effect at the end of the current subscription period. No amount already paid will be refunded pro rata, except in the case of a proven failure of the service attributable to the publisher or a contrary mandatory legal provision.

10. After-sales support

Any complaint, question, or request relating to a subscription must be sent to contact@hyvirtus.com. The publisher undertakes to respond within a reasonable time, and at the latest within fifteen days.

11. Legal warranties

The consumer benefits from the legal warranty of conformity provided for in Articles L217-3 et seq. of the French Consumer Code, as well as from the warranty against hidden defects provided for in Articles 1641 et seq. of the French Civil Code, under the conditions and limits provided for by law.

12. Mediation and dispute resolution

In the event of a dispute, the consumer is invited to first contact the publisher at contact@hyvirtus.com. Failing an amicable resolution within one month, they may use the consumer mediator the publisher is registered with, free of charge:

13. Applicable law and jurisdiction

These terms of sale are governed by French law. In the event of a dispute, and in accordance with Article R631-3 of the French Consumer Code, the consumer may bring the matter, at their choice, before the court of the place where they were residing at the time the contract was concluded or where the harmful event occurred, or that of the place of the defendant's domicile.

14. Protection of personal data

The processing of personal data in connection with subscriptions is governed by the privacy policy.
